Reviewing a China business visa file before submission

1. Refused or Returned: Know Which One You Have

Two different things are called "rejection". A returned application is one the visa centre or the embassy sends back, or asks you to complete, because a document is missing or does not meet the rules: a photo of the wrong size, an invitation without the required details, a business licence copy without the signed note. You fix it and submit again. A refused application is a decision by the consular officer not to issue the visa. This guide is written by our visa desk in Karol Bagh, Delhi, from the Chinese Embassy in India's published rules, the visa centre's notices and the Exit and Entry Administration Law of China, all listed at the end. Most problems we are asked about are of the first kind, and they are avoidable.

2. What Chinese Law Says About Refusals

Article 21 of the Exit and Entry Administration Law of the People's Republic of China (in force since July 2013) lists the situations in which a visa is not issued. In plain terms, they are:

  • the applicant was deported or repatriated and the period barring re-entry has not ended;
  • the applicant has a serious mental disorder, infectious tuberculosis or another infectious disease that may seriously endanger public health;
  • the applicant may endanger China's national security or interests, disrupt public order, or engage in illegal or criminal activity;
  • the applicant uses fraud in the visa application, or cannot guarantee the expected expenses during the stay;
  • the applicant fails to submit the information the visa authority requires;
  • other circumstances in which the visa authority considers the visa should not be issued.

The same article states that the visa authority is not required to give reasons for a refusal. That is why a refused applicant often hears no explanation. For a genuine business traveller, the two grounds that matter are the fourth and fifth: anything that looks false or inconsistent, and anything missing.

3. What the Embassy in India Requires for an M Visa

The embassy's notice on visa requirements (updated August 2024) and the visa centre's copy of it set out the M visa file:

  • The online application form and its confirmation page, printed and signed.
  • The original passport, valid for at least six more months with at least two blank visa pages, and photocopies of its data page; expired passports from the last five years with copies.
  • Photographs: recent colour photos, 48 mm by 33 mm, taken within six months, full face, bare head, neutral expression, no glasses.
  • An invitation: documents on the commercial activity from a trade partner in China, or a trade fair invitation, or another invitation letter.
  • A copy of the inviting company's business licence showing the business scope, and a copy of the inviter's (or the legal representative's) ID card. The licence copy must carry a handwritten note and signature by the company's responsible person, saying the document is used only for this applicant's visa application, with the date.
  • A covering letter from you or your company: your details, the purpose, the places to be visited, and the name, address and telephone of the inviting company or contact.

The invitation itself must give your full name, gender and date of birth; the purpose of the visit, arrival and departure dates, places to be visited, your relationship with the inviter and who pays; and the inviter's name, telephone, address, official stamp and the signature of its legal representative. Our invitation letter guide and documents checklist cover these in detail. Which office handles your application depends on your state: the Mumbai consulate covers Maharashtra and Karnataka, the Kolkata consulate covers Bihar, Jharkhand, Odisha, Chhattisgarh and West Bengal, and the embassy in Delhi covers the rest.

4. The Reasons Files Fail, From the Official Rules

ProblemWhat the official rule saysHow to avoid it
Photo not compliantThe embassy states that if the photo does not meet the requirements, the application will be rejected or returned.48 × 33 mm, colour, under six months old, plain background, no glasses, face fully visible, current appearance.
False, misleading or incomplete informationThe embassy notice warns this may lead to denial of the visa or refusal of entry into China.Make the form, invitation, covering letter and passport say the same thing: names, dates, places, company.
Invitation missing required detailsThe notice lists what the invitation must contain.Check purpose, dates, places, relationship, who pays, stamp and signature before you accept the letter.
Business licence copy without the signed noteThe licence copy needs a handwritten note and signature from the company's responsible person; a printed one is not accepted.Ask your supplier for it when you request the invitation.
Information not provided when askedArticle 21 lists failure to submit required information as a ground; officers may ask for more documents or an interview.Answer any request quickly and completely.
Expenses not coveredArticle 21 lists inability to guarantee expenses during the stay.Say in the invitation and covering letter who pays, and be ready to show funds if asked.

5. Seven Checks Before You Submit

  1. Passport: six months' validity beyond your return, two blank visa pages, and old passports from the last five years.
  2. Photo: the 48 × 33 mm specification, taken recently, as you look now.
  3. Names: spelled exactly as in the passport on the form, invitation and covering letter.
  4. Dates and places: the same on the form and the invitation; the trip makes sense for the stated purpose.
  5. Inviter: stamp and legal representative's signature on the invitation; the business licence copy with scope and the handwritten note; the ID card copy.
  6. Who pays: stated in the invitation and the covering letter.
  7. Visa history: if you ask for multiple entries, include your earlier Chinese visas; first-time applicants are generally given single entry, and the officer decides entries, validity and stay.

For a Canton Fair trip, the invitation comes from the fair's buyer system; the Canton Fair visa guide explains how to get it.

6. If Your Application Is Refused

Expect no reason: the law does not require one. The embassy states that when an application is refused, it charges no fee and the visa fee (and any express fee) is refunded through the visa centre; the centre's own service charges are handled separately. We have found no published waiting period before you may apply again. Before you do, go back over the grounds in section 2 and the checks in section 5: is anything inconsistent, missing or unclear about the purpose or who pays? Correct it, ask the inviter for a fresh letter if needed, and include an honest covering letter. A second application with the same file is likely to meet the same answer. If your travel date is close, message us and we will tell you honestly whether the timeline can still work.

7. What Changed in 2025 and 2026

  • No appointment needed: since November 2023 the visa centres accept applications on any working day without an appointment.
  • Online application system: since 22 December 2025, applicants in India fill the form and upload documents on the visa centre's online system.
  • Fingerprints waived for short stays: the embassy waived fingerprinting for short-term applicants (stays of 180 days or less, which includes the M visa) until 31 December 2026.
  • Reduced visa fees for applications in India were extended to 31 December 2026; the fee itself is confirmed when you book.
  • No visa-free entry for Indians: India is not on China's 30-day visa-free list or the 240-hour transit list, so business travellers need a visa.

Visa rules change; we check the embassy and visa centre notices before every file. Our China business visa service prepares and checks the file with you.

Common Inquiries

Frequently Asked Questions

Does the Chinese embassy give a reason for refusing a visa?

No. Article 21 of China's Exit and Entry Administration Law says the visa authority is not required to give reasons for a refusal.

What is the most common reason a China business visa file is returned?

From the embassy's own rules: a photo that does not meet the 48 × 33 mm specification, incomplete or inconsistent information, or an invitation or business licence copy missing the required details and signature.

Can I reapply after a China visa refusal?

Yes. We have found no published waiting period. Correct whatever could have looked inconsistent or incomplete before applying again; resubmitting the same file is unlikely to change the answer.

Do I get my fee back if my China visa is refused?

The embassy states that for a refused application it charges no fee and the visa fee and any express fee are refunded through the visa centre. The visa centre's own service charges are handled separately.
